Current rate:

For the month of October, 2008 the rate of return for the allocated units in the Trilogy first Mortgage Income Trust was: 8.78 % p.a.

The current Trilogy Short Term Investment Account yield is:5.04% p.a. as at Monday 17th November 2008.

Fee Waiver

Trilogy has decided to continue to waive its management fee of 0.77% (including GST) which is payable on the mortgage pool of the Trilogy first Mortgage Income Trust. This position will be reviewed on a periodic basis, and should there be any change, investors will be notified by way of update on this website.

Rebates

Our current fee rebates are outlined in the table below.

Borrowings:

The Trilogy first Mortgage Income Trust has put in place a funding facility provided by Westpac Bank. This facility is currently limited to the lesser of $2 million or 20% of the mortgage pool and will be predominately utilised to assist withdrawal efficiency. Westpac will hold a first ranking charge over the assets of the Trust.

The facility is subject to a number of terms including that it be repaid within 60 days of drawdown. Full details are provided in the Westpac Finance Agreement, a copy of which is available on request.

Capital Loss Insurance: The Lloyd’s of London capital loss insurance policy is current for the Trilogy first Mortgage Income Trust. In relation to the Trilogy first Mortgage Income Trust, there are no claims outstanding.

Trilogy has agreed that during the term of the Trust it will cap its fees in the following amounts:

Project Fee 2.5%
Rollover Fee 5%
Incentive Fee 5%.

Trilogy has also agreed to reduce its Property Management Fee to nil for the life of the NS Units.

INVESTOR CHOICE PROPERTY SYNDICATES

The Trilogy Investor Choice Property Syndicates are a means by which individual investors can, for a moderate investment, participate in ownership of substantial income producing commercial, retail or industrial property with the benefits of a reliable income stream, taxation deferral and the possibility of capital gain.

Trilogy Capital Group actively manages the Syndicates on behalf of the investors. Trilogy Capital’s vertically integrated platform of property skills is directed toward the objective of maximising investor returns within appropriate risk boundaries and preserving investor capital. This is achieved through active management.

Trilogy Capital strategy is to invest in commercial office, retail and industrial situated in principal capital city markets. Strong focus is placed on quality of income and tenant mix.

LLOYD'S OF LONDON UNDERWRITERS INSURANCE POLICY

Trilogy’s loans in the Trilogy first Mortgage Income Trust are insured under a Mortgage Indemnity Policy underwritten by certain Syndicates at Lloyd’s of London.

The policy covers the first loan principal (less prepaid interest and fees) loss up to $3 million for any one loan. Under the policy, Trilogy can write loans up to a maximum amount of $5M.

Lloyd's of London has a “Financial Strength Rating” from Standard and Poors and this is shown on www.lloyds.com.

Capital Loss Insurance

The effect of this insurance is to indemnify the Trust in the event of the forced sale of a mortgage property. The cover is subject to Trilogy Funds Management operating within the lending policy stipulated in the insurance policy.

The policy covers all capital loss (excluding prepaid interest and fees) of the loan principal.  The policy has an aggregate limit of indemnity in the amount of $10 million in any one policy year.

The policy does not cover loss of interest or fees.

Other Insurance Failure

Trilogy Capital has also arranged insurance through Lloyd's of London Underwriters to cover potential losses where a primary policy of insurance that the borrower is required to have under the terms of the loan (such as property damage) fails to respond to a claim for insured risks, subject always to the conditions of this policy.

It should be noted that this insurance is only applicable where stipulated in the relevant PDS or Supplementary PDS.

Claims on Lloyd's

As at 30 June 2008, there is one claim notified during the current policy period in the amount of $89,883.74.

Anti-Money Laundering and Counter-Terrorism Financing Act

The Australian Government has recently implemented the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (AML/CTF) designed to:

  • Bring Australia's AML/CTF system into line with international standards;
  • Reduce the risk of Australian businesses being misused for the purposes of money laundering or terrorism financing; and
  • Meet the needs of law enforcement agencies for targeted information about possible criminal activity and terrorism.

The goal of most criminal acts is to generate a profit. To enjoy their ill gotten gains, criminals commonly seek to disguise the illegal source of those profits. Money laundering is the processing of criminal profits to disguise their illegal origins.

Terrorist groups also move funds to disguise their source, purpose and destination. Terrorism financing includes the financing of terrorist acts, terrorists and terrorist organisations.

Both money laundering and terrorism financing are serious crimes.

The Australian Transaction Reports and Analysis Centre (AUSTRAC), the Government regulator for anti-money laundering and counter terrorism financing, have developed a flyer to help investors better understand the new legislation. Click here to download or view this booklet.

Trilogy Fund Management Limited is bound by the new legislation and as such will need to verify the identity of any new clients prior to any service being provided. (Changes to the current legislation may, in the future, impose other due diligence procedures or require the collection of further information from investors.

Verification of identity must be completed for all new clients.

Trilogy is using the industry-standard forms created by the Investment and Financial Services Association (IFSA) and the Financial Planning Association (FPA).)

Trilogy Funds Management Ltd (Trilogy) is committed to respecting your privacy and takes all reasonable steps to protect the personal information we collect from you.  

What Personal Information does Trilogy Collect?

Personal information collected by Trilogy may include your name, address, email address, banking details, date of birth, tax information and communication with your financial adviser.

Personal information is generally communicated to Trilogy when you complete an Application form attached to a Product Disclosure Statement (PDS) or other forms, or may be collected by other means. 

Use and Disclosure of Personal information

Trilogy will only use personal information for the purpose for which it was collected and any directly related purpose.  Trilogy only collects information that is necessary to assist us in providing financial services to you.

Trilogy collects personal information for the following uses:

  • To process your application to invest in Trilogy’s investment product(s);

  • To inform you of any other potential investment opportunities to be promoted and/or managed by Trilogy or any of its related entities;

  • To administer and manage our investment products (including calculation of entitlements and distributions);

  • To facilitate our internal business operations and comply with the law; and

  • For any other related purpose.

Your personal information may be disclosed to related entities of Trilogy and any other organisation that provides financial, administrative or other services for any of the above purposes (such as an accountant or auditor).  It may also be required to be disclosed under anti-money laundering and related legislation.

Other than as stated above, your personal information will not be disclosed to any other external parties without your consent, unless required by law.

Information Security

Trilogy takes reasonable steps to protect your personal information from misuse, loss, unauthorised access, modification or disclosure. 

Your personal information is stored securely in secured premises or in electronic databases requiring logins and passwords.

Your personal information may be kept for 7 years to comply with legal requirements.  We will take reasonable steps to destroy or permanently de-identify your personal information when it is no longer needed.  

Using e-mail and the Internet may not always be successful or secure.  Trilogy cannot be held responsible for the security or confidentiality of any information sent to us by e-mail or over the internet.

Access and Correction

Trilogy will take reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, complete and up-to-date.

You can help protect your personal information by taking all necessary steps to notify Trilogy when your personal information needs updating or is incorrect.

You can request access to your personal information by contacting Trilogy’s Privacy Officer on 07 3039 2828.  In normal circumstances we will give you full access to your personal information.  However there may be some legal or administrative reasons to deny access in which case we will provide you with reasons.

Easily accessible personal information will be made available to you free of charge.  Where you request personal information that is not easily accessible, we may charge you a fee for the cost of accessing or retrieving that information.
